“Contaminated Land Legal Update – Recent Judgments from the NSW Land and Environment Court” presented by Anneliese Korber & Krista MacPherson (Norton Rose Fulbright) and Andre Smit (GHD). Our speakers will present on selected recent judgements in the NSW Land and Environment Court as they relate to land contamination offences. Included will be a case study on the investigation and associated LEC proceedings on the illegal dumping of contaminated fill at a residential property in Arcadia.
1) Arcadia (EPA v Mouawad [2023] NSWLEC 76) – pollution of land offences
2) Muscat Developments Pty Ltd v Wollondilly Shire Council [2023] NSWLEC 121 – interaction between the contaminated land regime and the planning law regime
3) EPA v Ghossayn Group Pty Ltd; EPA v Ghossayn [2023] NSWLEC 127 – intentional offences and their seriousness
