Update to ACLCA Qld Chapter Constitution

Dear Members,

On 01 July 2024 the Office of Fair Trade (OoFT) introduced new requirements for grievance procedures for incorporated associations. This was to ensure associations have a defined and formal process to handle internal conflicts and help parties resolve them before legal costs are incurred. Therefore, to ensure ACLCA Qld maintains compliance with section 47A of the Association’s Incorporation Act, update of the ACLCA Qld Constitution was proposed to adopt the grievance procedure provided by the OoFT. A Special Resolution was required to amend the rules of the association.

The proposed resolution was voted on at a Special General Meeting on 05 December 2024 (Christmas party).and was ratified by more than 75% of members present to update the following sections of our Constitution:

  • Cessation of membership: Section 8.(1)(e) – reference to Grievance Procedure [Section 14]
  • Section 14 Grievance Procedure – Added to Constitution

Please note this change is the first step in the Executive Committee’s effort to update the Constitution to align with today’s standards and expectations including current Model Rules guidance from the OoFT.
